The Information Law Section is a talented, dynamic, and high performing team involved in exciting work that cuts across all Department priorities and allows the team to work collaboratively across Legal Group. The team provides specialist, complex and often urgent advice and services to policy and operational business areas of the Department and ABF on obligations in relation to the handling of information. This includes legal advice on information law issues including privacy, secrecy, and developing areas such as the use of AI. It also includes reviewing domestic and international agreements that deal with information sharing, advising on responses to media inquiries and public interest immunity issues in parliamentary processes.

 

Information Law is also involved in strategic projects involving complex and cutting-edge information law and data issues, such as AI, cross-border data issues, data matching, access or consolidation of databases, biometric information and the review of information sharing statutory frameworks.

Our ideal candidate

 

  • Interested in information law issues including privacy, secrecy, AI and information sharing
  • Understanding of, or ability to quickly obtain understanding of, relevant portfolio legislation and other legislation of general application
  • Excellent legal advice writing, judgement and analytical skills to support the effective implementation of the objectives of the Government and the Department
  • Superior written and verbal skills, including an ability to communicate complex ideas to a range of audiences in a range of styles, and concisely convey practical solutions.
  • Well-developed relationship management skills and the ability to develop productive working relationships with both internal and external stakeholders
  • High-level management skills, including the ability to manage tasks with limited supervision and the ability to supervise and mentor Legal Officers
  • Flexibility, adaptability and resilience, and the ability to work effectively in a fast-paced and unpredictable environment.

 

Duties and responsibilities

 

  • Providing high quality, timely and practical legal advice to support the portfolio's ability to meet its strategic priorities and outcomes. The advice may be on high profile, complex, technical, or sensitive issues and focus on delivering accurate legal analysis, options and recommendations, and the strategic management and assessment of legal risks
  • Liaising with, and actively developing and maintaining working relationships across, the Legal Group, the wider Department and with external stakeholders
  • Developing specialist knowledge and expertise in information law and particularly the complex legal framework that applies to information law issues relevant to the Department
  • Exercise a high degree of professional judgment in the prioritisation and delivery of tasks
  • Providing and managing legal services in accordance with the Legal Services Directions 2025
  • Creating complete and accurate records in accordance with the Department's Recordkeeping Policy
  • Providing legal clearance, mentoring and professional support to other legal professionals.

 

Additional information

 

Essential Qualifications

  • A degree in law from an Australian university, or a comparable overseas degree which is recognised in Australia for admission to practice
  • Admission as a practitioner, however described, of the High Court of Australia, or the Supreme Court of an Australian State or Territory
  • Practising Certificate or eligibility to attain one.

 

Role Requirements

  • A minimum of 2 years PAE is required

Eligibility

 

To be eligible for the position you must be an Australian Citizen.

 

The successful candidate will be required to obtain and maintain a Baseline Vetting (AGSVA) security clearance, and:
 

  • ABF Workers will also be required to obtain and maintain an Employment Suitability Clearance (ESC).
  • Home Affairs Workers will also be required to obtain and maintain an Onboarding Check.
     

In certain circumstances, an Employment Suitability Clearance (ESC) may be required in addition to, or in lieu of, an Onboarding Check, which will be determined by the delegate as necessary.
